Conditions of Sale
These terms govern the relationship between Etrusca Auctions Ltd and all participants in its auctions, including bidders and buyers. By registering for and participating in our auctions you agree to be bound by them.
Agency
Etrusca Auctions acts as agent for the seller unless otherwise stated. The buyer’s contract of sale is directly with the seller. The seller warrants that they are the rightful owner of the item, or have legal authority to sell it, free of third-party claims.
Descriptions and condition
We endeavour to describe lots as accurately as possible, but descriptions of condition, authenticity, age, origin or value are opinions given in good faith. Buyers are encouraged to inspect lots before bidding; condition reports are available on request. All items are second-hand and are sold “as seen”.
Buyer’s premium and VAT
The purchase price is the hammer price plus a buyer’s premium of 25%, which is subject to VAT at the applicable rate. Shipping, online bidding surcharges and VAT on services are charged separately.
Reserves and bidding
Lots may be sold subject to a confidential reserve. The auctioneer has sole discretion to refuse any bid, set bidding increments, and withdraw, divide or combine lots. A binding contract is formed on the fall of the hammer, when risk passes to the buyer.
Payment and collection
Full payment is due within five working days of the auction and purchases must be collected within five working days. Ownership passes only on receipt of full payment.
Non-payment or failure to collect
We reserve the right to seek damages, resell the item and hold the buyer responsible for any shortfall, charge storage of £10 per day (plus VAT), charge interest at 1.5% per month on unpaid balances, and retain any items bought until full payment is made.
